APPEARANCE RELEASE, WAIVER AND GENERAL RELEASE
1. In consideration of the opportunity afforded me to appear and/or participate in the production of various interviews, programs, commercial advertisements, promotional materials, testimonials, media events, etc. in connection with the Westminster Kennel Club Dog Show and surrounding events beginning on or about January 31, 2026 and continuing through and including February 3, 2026 taking place at the the Jacob K. Javits Convention Center and Madison Square Garden, NYC, (my “Appearance”) produced by Fox Sports 1, LLC (“Producer”), and for good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I grant to Producer and Producer’s successors, assignees, licensees, promotional partners and affiliates (collectively “Producer Affiliated Entities”) the rights set forth herein.
2. Producer and Producer Affiliated Entities will have the irrevocable and perpetual worldwide right, but not the obligation, to use, as they may desire, all still and motion pictures and recordings that Producer makes of me or my voice during the Appearance, including, without limitation, the right to use my name, voice, image, likeness and biographical information (collectively, my “Likeness”), in connection with advertising, publicizing, promoting, exhibiting, distributing and exploiting my Appearance, in whole or in part, in any manner whatsoever, by any and all means, media, devices, processes and technology now or hereafter known or devised in perpetuity throughout the universe.
3.Producer has my consent to incorporate into the Program and any advertising or promotions related thereto, any photographs, and/or motion pictures, news and/or television footage in which I appear, and I hereby waive any right to any additional compensation therefore, including but not limited to any excerpt and/or reuse fees and/or residual payments.
4. I acknowledge that my appearance in advertisements and promotions and any works related to my Appearance, or otherwise, constitutes part of my Appearance and that I shall not be entitled to any compensation for such. For avoidance of doubt, I shall not be entitled to any compensation for my Appearance and any use of my Appearance as described herein. I further acknowledge that the production of any content in connection with my Appearance are non-union productions and that my Appearance shall be on a non-union basis and I release and indemnify Producer, its respective successors, assignees, licensees and affiliated entities from and against any broker and agency fees or commissions, guild and union payments, and any other third party payments attributed to the Appearance or Producer or Producer Affiliated Entities’ use of the results and proceeds of my Appearance.
5. I hereby release Producer, the Producer Affiliated Entities and their respective direct and indirect owners, officers, agents, directors, employees, partners, representatives and attorneys, and any and all of its respective parents, subsidiaries, affiliates, successors, licensees and/or assignees (collectively, the “Releasees”), from any and all claims, demands, or causes of action arising out of or in connection with the uses set forth herein, including, without limitation, any and all liability arising out of Producer’s taping and/or recording of me, my voice, image, likeness and use thereof, any and all claims for invasion of privacy, infringement of my right of publicity, defamation (including libel and slander) and any other personal or property right, regardless of whether based on fault or negligence of any person, including Releasees, and I agree that I shall not now or in the future assert or maintain any such claim against Releasees, and not otherwise bring any claim or cause of action or assign any cause of action to any third party against any of the Releasees (individually or collectively). I acknowledge and agree that the Releasees shall not be liable for injury or death of any person while engaging in my Appearance and further that the Releasees are not responsible for damage or destruction of property from any cause. I hereby further agree to indemnify, defend and hold the Releasees harmless from and against any and all losses, damages, claims, liability, costs or expenses (including attorneys’ fees and other costs or defense) which any of them may sustain as a result of, or in connection with, my participation in my Appearance. I further agree that in the event of any claim, liability and/or expense related to or arising from any challenge to the terms and/or enforcement of this Appearance Release, Waiver and General Release, I shall indemnify Releasees and pay for the cost of the defense including attorneys’ fees and costs that may be incurred.
6. I will refrain from any offensive or distasteful remarks or conduct in the rendering of the Appearance hereunder and will conduct myself in a courteous and professional manner at all times during the rendering of the Appearance.
7. I understand that Producer has been induced to proceed with the production, distribution and exploitation of my Appearance in reliance on this release, but nothing herein shall obligate me to render the Appearance. If any disputes arise which are related in any way to this document, then jurisdiction shall be in Los Angeles County, California, irrespective of the place of execution or performance of this release or my Appearance.
8. I shall not be entitled for any reason to terminate or rescind this Appearance Release, Waiver and General Release nor to enjoin, restrain or otherwise impair the exercise of any rights and privileges granted or to be granted to Producer and Releasees hereunder, nor to restrain, enjoin or otherwise impair Producer and Releasees’ property or assets, or the development, production, exhibition and/or exploitation of any Producer content or programming containing my Appearance or any advertising, publicity or promotion in connection herewith.
9. I acknowledge that I am eighteen (18) years of age or older or, if the individual participating in the Program/giving the Appearance is under the age of eighteen (18) years, I am the parent or legal guardian of such individual and am signing below on their behalf and that such minor individual will be bound by all releases, consents and covenants contained in this Release. I further acknowledge that I have read this Appearance Release, Waiver and General Release carefully and in its entirety. I fully understand it, and I have resolved to my satisfaction all questions concerning its content. I acknowledge that I am signing this document of my own free will, with full knowledge of the risks that I am assuming.
